Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Hoode (the “App” or “Services”). The Services are operated by Hoode (“we,” “us,” or “our”). By downloading, accessing, or using Hoode, you agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility

You must be at least the minimum age required to use the Services in your jurisdiction. By using the Services, you represent that you meet that requirement and that you have the legal capacity to enter into these Terms. If you use the Services on behalf of a company or other entity, you represent that you have authority to bind that entity.

2. Your Account

You may need to create an account to use some features of Hoode. You agree to:

• provide accurate and current information;
• keep your account information updated;
• maintain the confidentiality of your login credentials;
• notify us immediately of unauthorized use of your account; and
• accept responsibility for activity that occurs under your account.

We may suspend, restrict, or terminate your account if we believe you violated these Terms, provided false information, or engaged in harmful conduct.

3. Privacy

Our collection and use of personal information are described in our Privacy Policy, which is incorporated into these Terms by reference. By using the Services, you agree to the Privacy Policy.

4. The Services

Hoode is a social platform that may include profile creation, discovery, matching, group features, messaging, boosts, premium access, and related tools.

We do not guarantee:

• any match, any conversation, or any meet-up;
• any specific visibility or engagement outcome; or
• any uninterrupted access to the Services.

We may modify, add, remove, suspend, or discontinue features at any time.

5. User Content

You retain ownership of your User Content, but you grant us a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, modify, display, distribute, and otherwise use your User Content only to operate, improve, and promote the Services. You are solely responsible for your User Content and represent that it does not infringe on third-party rights or violate any laws.

6. Prohibited Conduct

You agree not to use the Services to harass, stalk, spam, scrape, or impersonate others. Posting sexually explicit, violent, or hateful content is strictly prohibited. You may not reverse engineer the Services or upload harmful code. We may remove content or restrict features if we believe these rules were violated.

7. Boosts and Paid Features

Hoode offers boosts (consumable digital items) and subscription plans. Boosts are non-transferable, non-redeemable for cash, and do not guarantee specific outcomes or interactions. All purchases are final and non-refundable except where required by law.

8. Purchases, Billing, and Taxes

Purchases are processed through Apple, Google, or RevenueCat. You agree to pay the stated price and any applicable taxes. We do not store your full payment card details; processing is handled by third-party app marketplaces.

9. Subscriptions

Subscriptions may automatically renew. You are responsible for managing and canceling subscriptions through your Apple App Store or Google Play Store settings. We cannot cancel subscriptions on your behalf inside the App.

10. Account Deletion and Retention

You may request account deletion at any time by contacting us at dev@hoode.in. After deletion, some records may be retained for legal, security, or accounting purposes.

11. Intellectual Property

The Services, including software, design, and branding, are owned by us and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Services without permission.

13. Copyright Complaints

If you believe content infringes your copyright, contact us at dev@hoode.in with sufficient information to identify the claim.

16. Limitation of Liability

To the fullest extent permitted by law, our total liability for any claim is limited to the lesser of the amount you paid us in the 6 months prior to the claim, or ₹1,000 in INR.

18. Dispute Resolution

Parties agree to attempt informal resolution for 30 days. If unresolved, disputes will be submitted to arbitration in Lucknow, India, in English, before one arbitrator.

19. Governing Law

These Terms are governed by the laws of India, without regard to conflict-of-law rules.
